These terms apply when you use FanGifts, an app for Fanvue creators and their subscribers. FanGifts is provided by Polar Industries, based in the United Kingdom ("we", "us"). By using FanGifts you agree to these terms. If you don't agree, please don't use it. Contact us at support@polarindustries.co.

1. What FanGifts is

FanGifts lets a Fanvue creator set up a gift shop that their subscribers can open inside Fanvue. Fans buy virtual gifts through Fanvue checkout. A gift can be a simple gesture, unlock content the creator has chosen, or ask the creator for a personal voice reply. FanGifts is an independent app, not made or endorsed by Fanvue.

2. Using FanGifts

  • You need a Fanvue account, and must meet Fanvue's requirements, including being 18 or over.
  • You must follow Fanvue's terms and content policies when using FanGifts.
  • Creators approve FanGifts' access to their Fanvue account inside Fanvue, and can remove it at any time by uninstalling the app.

3. Creators

  • You decide what your gifts are, what they cost and what they include, and you're responsible for them being accurate, lawful and allowed by Fanvue's policies.
  • If a gift promises a personal reply, you're responsible for sending it within the time you set. If you can't, contact the fan or arrange a refund through Fanvue.
  • You're responsible for any taxes on your earnings.
  • FanGifts is currently free for creators. If that changes, any charges will be made through Fanvue and shown before you agree to them.

4. Fans

  • Gifts are a way to support a creator. Each gift says what, if anything, it includes.
  • Payments, refunds and disputes are handled by Fanvue under its terms. FanGifts never receives your card details.
  • Personal replies are made by the creator, not by us. Content unlocked by a gift stays available to you even if the payment is later refunded, because Fanvue doesn't let apps withdraw access once granted.

5. Acceptable use

Don't use FanGifts to:

  • break the law or Fanvue's policies, or harass, exploit or harm anyone;
  • send requests that are abusive, or ask a creator for anything their Fanvue policies don't allow;
  • interfere with FanGifts or Fanvue, get around their security, or access data that isn't yours.

We can suspend access for anyone who breaks these rules. To report misuse, email support@polarindustries.co.

6. Your content and data

You keep ownership of what you create and send. You let us store and display it only as needed to run FanGifts. How we handle personal data is explained in our Privacy Policy. Creators can delete their FanGifts data at any time from the dashboard.

7. Availability and changes

We work to keep FanGifts reliable, but can't promise it will always be available or free of errors, and it depends on Fanvue's services. We may change or improve FanGifts, and will give notice before any change that significantly affects creators.

8. Liability

FanGifts is provided "as is". To the extent the law allows, we aren't liable for indirect or consequential losses, or for lost profits, revenue or data, and our total liability to you is limited to the amount you've paid us in the 12 months before the claim. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that can't be limited by law, and nothing affects your statutory rights as a consumer.

9. Ending

You can stop using FanGifts at any time by uninstalling it in Fanvue, and creators can delete their data from the dashboard. We may stop providing FanGifts, and will give creators reasonable notice if we do.

10. Changes to these terms

We may update these terms. We'll change the date above, and tell creators about significant changes before they take effect. Continuing to use FanGifts after that means you accept the new terms.

11. Law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction, except where your local consumer law gives you the right to bring a claim where you live.
